Terms of Service
These Terms of Service ("Terms") govern your access to and use of Homish (homish.in) and constitute a legally binding agreement between you and Homish Technologies Private Limited ("Homish," "we," "our," or "us"). By accessing or using the platform, you agree to be bound by these Terms. If you do not agree, you must not use the platform. You must be at least 18 years of age to use Homish.
1. Platform Overview
Homish is a digital platform that enables users to discover, list, and transact real estate, including buying, selling, renting, and participating in property auctions. Homish acts solely as an intermediary and does not own, control, or transact in properties. All transactions occur directly between users.
2. User Accounts
You are required to register an account to access certain features. You agree to provide accurate, complete, and up-to-date information and to maintain the confidentiality of your login credentials. You are solely responsible for all activity under your account.
Users may not create multiple accounts or impersonate others. Brokers and intermediaries are prohibited from using the platform to source leads or data for external business purposes.
Homish reserves the right to suspend, restrict, or terminate accounts at its sole discretion, including for violations of these Terms or suspected fraudulent activity. You may delete your account at any time; however, termination does not relieve you of obligations incurred prior to termination.
3. Property Listings
By listing a property on Homish, you represent and warrant that you have full legal authority to list the property (as owner or duly authorized representative), that all information provided is accurate, complete, and not misleading, and that all images and content are authentic and fairly represent the property. You agree to keep listings updated, promptly remove properties that are no longer available, and honor the stated terms of any transaction. Listings that are unauthorized, misleading, fraudulent, disputed, illegal, or that contain false information or images are strictly prohibited. Homish reserves the right, at its sole discretion, to review, remove, suspend, or restrict any listing or account and to take appropriate legal action in the event of violations.
Homish undertakes a structured verification process that may include review of property documentation, ownership details, registration records, and other relevant information submitted by users in order to enhance trust and platform integrity. However, such verification is limited in scope, conducted on a best-effort basis, and is dependent on the accuracy and completeness of information provided by users and third parties. Accordingly, Homish does not warrant or guarantee the legal validity, accuracy, completeness, or authenticity of any listing, property, document, or user representation, and any reliance placed on such verification is strictly at the user's own risk. Users remain solely responsible for conducting independent due diligence, including verification of title, encumbrances, and regulatory compliance, as well as physical inspection of properties and obtaining appropriate legal or professional advice prior to entering into any transaction.
4. Fees and Payments
Homish operates on a success-based pricing model:
- Browsing and listing are free
- A pre-authorization (mandate) may be placed when submitting an offer
- Fees are charged only upon successful transaction completion
Fee structure:
- Buyers: 0.25% of transaction value
- Sellers: 0.25% of transaction value
- Shared accommodation: will be flat transparent fee structure
All applicable fees will be disclosed prior to transaction completion.
Payments are processed via third-party providers. Homish does not store full payment credentials. Any disputes must be raised within 30 days.
5. Prohibited Conduct
You agree not to:
- Provide false or misleading information
- Impersonate any individual or entity
- Use the platform for unlawful purposes
- Harass, abuse, or spam other users
- Scrape, extract, or misuse platform data
- Circumvent platform fees or complete off-platform transactions
- Interfere with platform security or operations
- Use bots or automated systems without authorization
Violations may result in suspension, termination, and legal action.
6. Intellectual Property
All platform content, including branding, design, software, and features, is the exclusive property of Homish and may not be copied, modified, or distributed without prior written consent.
You retain ownership of content you upload but grant Homish a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content for platform operations and promotion. You represent that you have all necessary rights to such content.
7. Limitation of Liability
To the fullest extent permitted by law, Homish shall not be liable for:
- Accuracy or completeness of listings
- Conduct or actions of users
- Property transactions or outcomes
- Financial or indirect losses
- Third-party services or integrations
- Platform downtime or technical issues
Homish's total liability shall not exceed the fees paid by you in the preceding 12 months.
8. Indemnification
You agree to indemnify and hold harmless Homish, its affiliates, officers, employees, and agents from any claims, damages, liabilities, or expenses (including legal fees) arising from:
- Your use of the platform
- Your violation of these Terms
- Your infringement of third-party rights
- Any content submitted by you
9. Dispute Resolution
These Terms are governed by the laws of India.
In the event of a dispute:
- You agree to first seek resolution by contacting contact@homish.in
- If unresolved within 30 days, the dispute shall be referred to arbitration under the Arbitration and Conciliation Act, 1996
- Arbitration shall take place in India and the decision shall be final and binding
You agree to resolve disputes individually and waive any right to class action proceedings.
10. Modifications
Homish may update these Terms at any time. Changes will be communicated via the platform or email. Continued use after such updates constitutes acceptance. If you do not agree, you must discontinue use and may request account deletion.
